Wife Overrides Husband

A man suffers cardiac arrest and dies in the hospital. His daughter has been on dialysis for a while, but the man refused to give his kidney. He did not sign an organ donation card. His wife wants the man’s kidney given to his daughter. Should the hospital honor the wife’s request?

  1. The man refused to sign the organ donor card so he legally the hospital should not honor the wife's request. The reason being is that in the United States procures organs from an opt in system where the person must sign a form that indicates that the hospital is allowed to remove their organs once they have passed away.
